Many years ago when my husband divorced his ex-wife, he was self-empoyed and missed several payments. Four years ago, he filed necessary documentation to have the arrears included with his monthly payments, increasing his payments monthly to include an additional $100. After four years, the Texas Attorney General’s office is showing it outstanding and consistently late. We are trying to purchase our first home but are having trouble getting the financing as his FICO score is reflecting this issue. What can we do to get around this issue and get approved? We have documentation that shows he is current on child support and current on the agreement to pay arrears.

The house was surrendered the house due to arrears, but only a few days ago. I now want to re-buy the house for my friend then sell it to get the equity out of the house and return the difference to the friend. Buying the house for me is not an option, neither is a family loan, they never work. The house was a council house which they now own.

Q1. Would a mortgage company refund the difference to the owner if/when the house sells for more?

Q2. Would the mortgage company allow us to pack back the arrears, now?

Q3.Is there a time limit to sell an ex-council property and not have to pay something to the council?

Help please… got to get this sorted and get the max equity out for the friend.

The house is taken on less than the market value which means at the discounted price.

The cash can be used by the homeowners to settle the mortgages if there are any. Outstanding debts can also be clarified and they can be paid too. Many companies also offer the scheme to buy back the house at a later time in future at the market value of that day. The legal matters are set within very few days because of the earnestness of the company. Most of the sell and rent back vendors claim that the borrowers get 70-85 % of the money which means a little loss, whatsoever. But there are also some incentives behind these schemes too.

Discretion is also offered by the firms offering sell and rent back schemes. There neighbours need to tell the neighbours and the discretion is fully used at the general basis. But there are also some major drawbacks of sell and rent back schemes. Homeowners have to sell their home at a discounted price which means a certain bit of loss instantly. The quick sales company deals only with the people who need to pay their debts immediately without any hassle. These companies are always there to look out for people who want to sell their house in a hurry which means an instant profit for these companies.

The only possible solution is not to fall into the snares of these companies but if a person needs money immediately then there is no choice. The internet has allowed these sell and rent back companies to grow very easily. These companies try to find the people who are in need of money and at the end they carry out the whole deal at their cost. But the person who wants to go for the sell and rent back schemes should always go for some other easily available options.

Most of the companies are part of wider groups and they are the big firms who carry out big businesses. These business minded people tries to get hold of the lower middle class and they shows the money power to lure them instantly. The vendors are always there to help these companies because they get their own commission by bringing the clients. At the end it does not seem feasible that an individual should go for sell and rent back schemes because of the loss incurred in it. The loss incurred is much greater in the sell and rent back schemes than any other scheme.

There is talk about getting residents current in the HOA fees by re-negotiating a cable contract (basic cable is included in the HOA fees) and installing water meters (water is also included) and shutting both off if someone is in arrears. Is this even possible? Wouldnt the assoc. have to re-do the bylaws first? I think its comical that if someone is in arrears because they need to pay their mortgage first, that the assoc. is going to threaten us with no cable and no water.

what you have now and let you pay the remainder in two weeks. Last time I talked to them, they wanted 9000 (incl. legal fees), now another payment is due. I can pay 8800 now and in two weeks I can pay 1000.

I am struggling to keep up my mortgage payments (due to health problems and loss of job) and have arrears and will be taken to court shortly and i dnt think they will side with me this time, im just wondering if i will b able to get another mortgage in the future as i would like to own a home again later again in life, im even thinking just giving up and letting them take it without a fight as im struggling as i could only get a basic job. The big problem is i cant sell as i bought it off my local council 2 years ago and wouldnt be able to sell and clear the arrears and pay back the discount.
any help would be great

Once you’ve cleared all the arrears?

We went to Court last summer as we’d fallen into arrears with our mortgage. The Judge granted a suspended repossession order.

We’ve since cleared all the arrears off but the mortgage Co says the Order still stands even though the account is now bang up to date. Is this right? Sounds wrong to me.
