What can my HOA do if I’m in arrears on my dues?

There is talk about getting residents current in the HOA fees by re-negotiating a cable contract (basic cable is included in the HOA fees) and installing water meters (water is also included) and shutting both off if someone is in arrears. Is this even possible? Wouldnt the assoc. have to re-do the bylaws first? I think its comical that if someone is in arrears because they need to pay their mortgage first, that the assoc. is going to threaten us with no cable and no water.

I’d think that changes that drastic require approval of the general membership bya majority amendment; but pretty much every HOA by-law and CCR is written and ruled differently.

I’d take my copy to a lawyer for a review.

They can most likely do what they’re threatening already. You need to take a look at the existing by-laws.

And it can get worse. The HOA can foreclose on your property. I’ve done it before.

anybody that is in the arrears of paying their dues for what ever reason needs to contact them and make some type of payment arrangements. Ignoring it can cause you to loose it. By-laws has nothing to do with working on your arrears when there is ways to handle such.
Everyone has problems and there is ways to work on them in having communication open with making arrangements.
